The Federal Antimonopoly service (FAS) will soon initiate proceedings against IBM and HP, according to RIA Novosti, citing a statement by the head of Department Igor Artemyev. These companies are suspected of illegal economic coordination.
“There are checks. But that is the case — do not hesitate. There will definitely be the case. There is evidence of the offense on the face,” said Artemyev told reporters.
As explained RBC representative of the FAS, the Agency will decide on the initiation of separate proceedings against IBM and HP until the end of March.
The Lenovo representative declined to comment. The HP representative failed to promptly answer the questions of the RBC.
In early February, the FAS initiated a case against JSC “kraftvey Corporation PLC”, LTD “Adaptive technologies” and LLC “Express+Service”. The Agency believes that these companies entered into a cartel in the supply of production machines Lenovo and HP for fku “Nalog-SERVIS” of the Federal tax service, Federal customs service and the Pension Fund of Russia in the amount of 2.25 billion rubles, said the representatives of the FAS in early February. In this procedure, Lenovo and HP in this case did not appear.
In November 2016, the FAS initiated proceedings on signs of violation of clause 2 part 1 article 11 of the law on protection of competition in respect of LLC “Business computers group”, LLC “AMI-NETVORK, ZAO CROC incorporated”, “Superveyv Group”, ZAO “kraftvey Corporation PLC” and JSC “Production company Aquarius”, which was also suspected in the conclusion of anticompetitive agreements on delivery of computers for the system of gas “Vybory”. As was stated by the representative of the FAS in the auction procurement was no bargaining, the price dropped to a maximum of one step. In addition, the lots not claimed by the Russian producers by law have the advantage (15% to the price) to foreign companies. According to the FAS, this behavior of the Russian dealers could be coordinated for foreign manufacturers.
